When Is Employee Harassment Illegal?

Contrary to common belief, not all forms of harassment are illegal in the workplace. Generally, harassment is unlawful if it involves severe and pervasive communication involving race, sex, religion, national origin, disability, weight, age, and various other protected groups. Harassment usually surfaces in the form of the following:

  • Quid pro quo: such as demanding favors, dates, or other acts for a promotion, raise, special assignment, or another advancement
  • Hostile work environment: such as a sexually charged environment, racial remarks, sexual remarks, improper touching, the supervisor “hitting on” an employee, and other harassment that causes a hostile work environment

Helping Working People Defend Their Rights

If you are made to feel uncomfortable, with sexual harassment or other harassment at work, it is important to report the harassment to your supervisor or human resources department. If your employee handbook has a policy for reporting harassment, it should be followed.
