When Is Employee Harassment Illegal?

Contrary to common belief, not all forms of harassment are illegal in the workplace. Generally, harassment is unlawful if it involves severe and pervasive communication involving race, sex, religion, national origin, disability, weight, age, and various other protected groups. Harassment usually surfaces in the form of the following:

  • Quid pro quo: such as demanding favors, dates, or other acts for a promotion, raise, special assignment, or other advancement
  • Hostile work environment: such as a sexually-charged environment, racial remarks, sexual remarks, improper touching, supervisor "hitting on" an employee, and other harassment that causes a hostile work environment
